There is nothing illegal about initiating a pre-recorded message to a phone number of your choice in compliance with our Terms of Service. However, as with any telecommunications service, it is illegal and a violation of our Terms of Service to use PrankDial’s services for the purpose of defrauding, harassing, or harming anyone, or to wrongly obtain anything of value. Users are also strictly prohibited from using PrankDial to call emergency lines, health care facilities, government agencies, employees or officials, law enforcement, schools, numbers assigned to radio common carrier services, or any service for which the called party is charged for the call. PrankDial uses the utmost caution in crafting pre-recorded messages that are funny yet benign. For more information, please read our Terms of Service.
Some states permit recording with the consent of one of the parties, while other states require the consent of all parties. If you initiate a call through PrankDial, then you are a party to that call and must remain on the line through the entire call. You, as a party to the call, consent to the recording of that call. PrankDial can record telephone calls in those states which only require the consent of one party. However, the following states require the consent of all parties and it is a violation of PrankDial's Terms of Service to record calls in such states: California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, and Washington
The Federal Communications Commission regulations implementing the Truth in Caller ID Act of 2009 prohibit the transmission of misleading or inaccurate Caller ID information with the intent to defraud, cause harm, or wrongfully obtain anything of value. PrankDial, in particular, sends pre-recorded messages to recipients and has 100% creative control as to the content of these messages. PrankDial does not intend the calls to defraud, cause harm, or wrongfully obtain anything of value. Users are strictly prohibited from using the PrankDial services with the intent to defraud, cause harm, or wrongfully obtain anything of value and doing so is a violation of PrankDial’s Terms of Service.
As discussed in the PrankDial Terms of Service, by posting any recordings to PrankDial or any other forum, you represent that you have the right to post that recording and you release and indemnify PrankDial for any claims regarding that posting.
